In the country over the past few years, the government and police bodies have increasingly relied on automated units to do the bulk of the police speed and traffic violation detection. These units amount to camera systems mounted in prominent areas that record drivers that, for whatever reasons, have broken the law within the range of offences that the units cover.  This, frees officers from mundane duties to those more worthy and necessary in the public eye, like going after hard core offenders and those most likely to inflict bodily harm on the general public. Even knowing this, a majority of the public still sees the use of speed cameras and the like as something that’s invasive on how we live our lives, and not as a safety measure used to protect us all. This is where speed camera detectors come in. 

 

In a nutshell, these commercially available units allow the user to detect from in front or in back (some both, some not) the placement of a camera unit that uses either radar or laser to guide it in its deployment of the photographic abilities the unit has. This enables the driver to then tailor his driving to be excluded from the range that would trigger use of the camera unit in its crime fighting configuration. 

 

So, are speed camera detectors legal? As of right now, yes, they are fully legal, however, like any company the government is not standing still on this, and is in the process of developing new capabilities that will both circumvent the speed camera detectors themselves (in some cases the government is asking for the removal of the detection capabilities from the speed camera detectors) and in some areas make them completely redundant as new technology and new ways of using older tech comes into place. 

 

From the governments stand point, all the energy and time spent looking for cameras and camera ‘traps’ is only to the good, as it continues to make people aware of the pitfalls and areas to be wary of when driving which, when all is said and done, is exactly the reason that these units have been installed in the first place. The primary reason behind all of the technology being employed is simply to save lives, not to make anyone’s life more difficult on purpose. 

 

Will speed camera detectors remain with us? There is no doubt that as soon as the government employs some new tech to work in these areas that someone, somewhere, will bring together a counter technology to detect or deter anything brought in by the government, and that these new technologies will fall within, just barely, staying legal. So look to the future, and frankly, if you’re not breaking the law then you should have no problem.

How to Contest a Speeding Ticket Correctly

 

If you have been the recipient of a speeding ticket, either through the mail or in person, you must make the decision of whether you want to contest it or pay it. The one thing you must remember is you must complete the section 172 Notice and return it within 28 days. This applies even if you think or know you were not speeding. The notice must be returned with your name. 

 

The defences to speeding tickets are several and if you are planning on contesting your ticket, you should know which ones are acceptable. The reasons for disputing a ticket would be that you were not speeding, you believe the car that was photographed is not your car, you were not driving when the photograph was taken and there were no signs posted declaring the speed limit. There may be other extenuating circumstances that you may use for contesting a speeding ticket. 

 

The best way to contest your ticket is to follow the proper procedures. As we have said, return your section 172 notice when you receive it with all the information. After you do this, there are occasions when the police will send a Conditional Offer of a Fixed Penalty. This usually happens soon after they receive your section 172. 

 

The system for appeals is not set up as an official system but there are circumstances when they will accept a letter asking for an appeal of the ticket. For instance, if your car was stolen at the time the photograph was taken and you have reported it, they will listen to why you believe you should not have to pay the speeding ticket. 

 

Since all police departments do not have an informal way to appeal an erroneous ticket, you may have to file a formal appeal or pay the ticket. The way you do this is by requesting a court hearing. The Fixed Penalty Notice has a place where you can do this. You may want to consult a lawyer before doing this to see if he thinks you have a good chance of winning.  

 

If you choose to challenge the speeding ticket and it goes to trial, the prosecution will have to prove to the magistrate that when the photo was taken you were driving the car. They will also have to prove that the speed your car was going was over the limit for the road on which you were driving. This is one reason for choosing a lawyer. They know what to expect and can prepare the best defence if you are challenging a speeding ticket. 

 

Be prepared that if you are determined to be guilty of the offence, the fine will be higher than the one that you received on the Fixed Penalty Notice and the penalty points will be a greater number. 

 

The magistrate who hears your case has the authority to fine you up to £1,000 (if you were on a motorway when the photo was taken it can be £2,500), the loss of your driving privileges if you were driving more than 30 mph over the legal limit and adding between three and six point against your licence. Thinking on the positive side if he finds you are not guilty you will leave and that will be the end of the speeding ticket. If your offence is not serious enough to lose your licence over, the court may allow you to plead by post if your plea is going to be guilty with mitigating circumstances. 

 

The statement of mitigation you submit will be the reasons that you were speeding and why you feel you should not have a severe punishment. It is worth a try because it is possible this could have a bearing on the judge imposing a penalty that is not quite as harsh as it may have been. If you are pleading not guilty you will be asked if you have witnesses and then your case will be set for trial. 

 

A new date for the hearing will be set and you will need to come show the reasons why you are not guilty. The option of not going to the first hearing is yours because this is mainly to set the second hearing. Sometimes these hearings are allowed to operate via the post.

One of the most popular ways of getting speeding tickets in the UK is by the use of speed cameras. The Truvelo works with sensors in the road that capture the driver and the car without a flash. However, if you are driving a motorbike that does not have a front registration, this camera can not capture your speed. 

 

Digital Specs is another type of speed camera. This is a GPS speed camera service and is almost impossible to detect, other than simply seeing it. This is a camera that is found in different locations all throughout the UK, and works in a different way. Speeding Fines - How You Can Contest Them

 

There is no one that enjoys getting a speeding ticket or dealing with the speeding fines that come from them. It’s also all to easy to speed around without realizing it, and the next thing you know you have a ticket with a fine you have to pay. Of course there may be some times when you feel that you received a fine that you really didn’t deserve. In this case you may be wondering if there is anything that you can do to contest the ticket and the fine that you received. Well, there is. You can contest speeding fines, but you need to know how to do this the correct way if you want to have any luck. 

 

Start Out with Section 172

First of all, if you are planning to contest speeding fines, make sure that you send back that section 172 document. You have to do this in 28 days or less. Even if you don’t feel like you were guilty and you don’t think you really were speeding, you still have to fill this out and send in your name, saying that you were the one that was driving. This will give you the basis to get started with your defense when contesting the fine that you were given. 

 

Possible Defenses to Use

When you are trying to beat speeding fines and the charges that come along with them, there are several defenses that you can use that will be acceptable. Here are the defenses that you can use:

 

- Defense #1 - You Didn’t Speed - This means that you don’t believe you were speeding at all and you think that there may have been an equipment failure or some other mistake that has led to you being charged with speeding.

Contesting a Simple Fine

If you are merely contesting a simple speeding fine, then it is usually quite easy for you to go through this process. Here are the steps to follow in this case.

 

First of all you should make sure you return your section 172 notice within the allotted time after receiving the NIP (Notice of Intended Prosecution). This should give the details asked for about who was driving when the offense occurred. 

 

In some cases, you may get a Conditional Offer of Fixed Penalty. If this occurs, you should get it fairly quickly after sending in the section 172 paperwork. In some cases there is no way to appeal these conditional offers. However, you may be able to write to them and let them know why you don’t think you should be getting this fine. 

 

If there is not an informal way to appeal the speeding fine, or your informal appeal is rejected, you will have two choices. You can either go ahead and pay those speeding fines, or you can go on to contest the fine formally. If you want to do this, you’ll have to request a hearing in court. You can do this by filling out the correct area of your Fixed Penalty Notice. Once this is done you should get summoned to court, but it is a good idea to get some legal advice before you show up in court. 

 

Contesting the Fine in Court

Speaking of contesting the speeding fines in court; there is a particular way that this should be done as well. Here are some helpful steps to follow in this case. 

 

The very first thing to do if you plan on contesting your speeding fines in court is to see a good legal professional. Look for someone that has experience in the law regarding motor vehicles. They can help you come up with a good defense and let you know what is likely to occur in court. 

 

When you get the summons to court, you will also get a Plea and Mitigation form. This has to be filled out and you must send it in before appearing in court. You can either plead that you are guilty with circumstances that are mitigating or you can plea that you are not guilty.
